Chat Cards (“we”, “us” or “our”) is the fun social network where you can post, vote and share content and pictures with your friends or other users. Each picture that is posted can be played like a puzzle where you can win points. You can also vote on any post by selecting from the voting buttons and then you’ll see the results of how other people voted. Each time you vote on someone’s post, you’ll get a special little bonus game that’s fun to play and will earn you additional points. You’re level ranking will increase as you: earn more points; share and vote on posts; play picture puzzles and bonus games. You can post anonymously or as yourself and you can also submit private posts that only people you select will have access to. You can also set any of your posts to automatically disappear in 24 hours or you can set a post to remain posted until you decide to delete it.
We reserve the right to change, alter or modify this Policy at any time and for any reason that we deem necessary or appropriate. Any changes made will take effect immediately, unless we state otherwise. Your continued use of the Services following any revision we post will constitute your acceptance of the changes we have made.
We may make changes to this Policy from time to time and any changes to this Policy will be incorporated into this document. We will notify you of any changes by posting a “Revision Date” that we will display at the top of this Policy. We will attempt to notify members and users of our Services about changes to this Policy via ‘Alerts’ on the App, and/or by posting notifications on the homepage newsfeed, and/or via email. However, we encourage you to view this Policy page whenever you access our Services in order to see if a new “Revision Date” has been posted so that you can remain informed about any possible changes and/or updates that may have occurred.
By using the Services, you accept the terms and conditions of this Policy and our Agreement. You agree that we may collect, use and disclose information we gather, generate and/or obtain from you in the manner outlined and described in this Policy.
Some of the Services we offer may include, but are not limited to, software or programs that you can download to some and/or all of your various electronic devices such as but not limited to; computer; laptop; phone; smartphone; tablet, wearable device, television, entertainment device, communication device, internet device or other similar type devices (“Devices”). By using our Services and in accordance with this Policy, you agree that we may upgrade our software and/or programs to new, enhanced and/or modified versions at any time and that we may automatically download the newest version to your Devices.
This Policy applies solely to our Services only, not to other websites, apps, products or services that you may be able to access from our Services and/or reference or link to from our Services. Those other websites, apps, products or services may have data collection and use practices that differ from our practices along with different user agreements, privacy policies and cookie policies that we do not control and that do not apply to us through your interaction with them and therefore, we will not be held accountable or responsible when you interact with these other sources whether they are a sponsored advertiser or not associated and/or affiliated with us at all. This Policy will apply from the time of your first access and/or use of our Services. By accessing and/or using our Services, you affirm that you have read, understood, accept and agree to the terms and conditions of this Policy and our Agreement.
1. INFORMATION WE COLLECT:
When you become a user of our Services, the various information and personal identifiable information that we collect or that you provide varies with your use of our Services. We collect various types of information and we do it in several different ways. With respect to such users, among other things, we record traffic data that may include, without limitation, IP addresses, location, date and time of visit, time spent on our Services, interaction data, specific pages viewed, time spent on each page, time spent on each feature, exit information and search patterns and queries. This data is helpful for marketing purposes and to help us improve our Services for your enjoyment.
When you create an Account and use our Services, you will provide us with personally identifiable information and you consent to our collection and storage of that personal information on our database(s) and server(s). The type of personal information that we ask you to supply may depend on what aspect, and to what degree of our Services that you may be utilizing.
Personal information that you provide to us that we may collect, store and utilize may include but is not limited to the following: (1) Identification Data such as your name, photo, user name and password, birth date, gender, location, marital or relationship status, hobbies, school & occupation info, interests & dislikes; (2) Contact Data such as your name, street and/or mailing address(es), email address(es), telephone number(s), GPS device location; (3) Payment Data such as your credit card, debit card or bank account information; and (4) Usage Data such as how you reach our Services, your destination when you leave our Services, when and how you use our Services, your browsing, selling and/or purchasing and/or transaction history on our Services, time spent on our Services (including specific pages, features, posts, etc.), interaction time and interaction methods with others, search patterns and queries and keywords, search results and any information that you supply through the Services or that you otherwise communicate to us.
1a. Information you give to us:
You will be able to create an Account and profile page on the App and/or our Services in which you can communicate with us and/or others (either publically, privately or anonymously) that may allow you to view, send, transmit and/or post various content in which you are aware and agree that you are supplying us access with all such content. Such content includes but is not limited to: information, personal identifiable information, comments, responses, votes, gaming data, scores, point values and totals, ranking and level data, messages, listings, ads, search queries and search results, pictures, videos and captions, interaction data with others. When you create your Account and profile page, you may be providing us with such information as your name, user name, email address, phone number, city, state, password and profile picture, gender, age, hobbies, interests & dislikes, school and occupation info, marital or relationship status, along with other Info. There may be situations in which you may also provide us with your credit card number, debit card number, banking information, billing address, date of birth and/or other security information. We will also receive information from you when you communicate and/or contact us such as may take place through email, messaging, phone, text, regular mail, etc.
1b. Information you grant us permission to obtain:
Phone contact list and photos: Because our App was created for fun by allowing you to chat, play games and share pictures and videos with your friends and other users, we will ask you for permission to access your phone’s contact list, photo gallery, camera and microphone. By giving us permission to access this information, you will have a much more enhanced experience in using our App and/or our Services. By providing us this information, you will now be able to easily find, contact, follow and invite your friends on your contact list to have fun with you on the App and/or through our Services. And by giving us permission to your photo library and gallery and camera and mic, you will now be able to use our App and/or services to post existing pictures and videos you have or create so that your friends or other users can view, vote and share them.
Friends and Contacts: By using our App and/or Services and/or by allowing us access to your phone’s contact list, we will have access to information regarding your contacts, friends, followers and people following you. You can search for friends and people you know using our search tool and if you allow us permission to your phone’s contact list, then we will access your contact list in order to identify and present to you those contacts that are using our App and/or Services.
Metadata: Metadata is generally associated with information pertaining to your user content such as: comments; captions; or other data including but not limited to hashtags and geotags. Hashtags and geotags can make your posts and content more easy to search and find and can also allow your posts and content to be listed and bundled with other similar content. This makes finding your content much easier for users and helps identify and direct users to your content by either location or specific key words.
Location data: We may ask for your permission to obtain your device’s current location which is provided by your device’s mobile service using GPS or a similar location platform. It is your choice to allow us permission to receive this information or to block our access to it. If you provide us permission, we may utilize your location information for various functions and enhancements to our Services in order to make your experience with our Services more fun and rewarding. If location tracking is offered on our Services, then you will also be able to turn off our access to it at any time through your settings.
Revoking your permissions: You can always revoke any of your permissions by using the settings or preferences function of your Device. If you choose to delete the App and/or our Services from your Device, we suggest you first revoke your permissions in your Device’s settings.
1c. Information we automatically receive when you use our Services:
Log file data: When you use our Services, your browser and/or Device automatically reports certain types of information and our servers record those broadcasts. The type of information reported to us is defined as when you access or visit a website or mobile app by exiting or coming out of our App or Services and/or linking to another source from our App or our Services. Other log file data we could record is your Internet Protocol (“IP”) address, browser type, referring and/or exit pages and website addresses, search requests, landing pages, date and time of your requests, length of time on our Services and time spent on each page and/or function, number of clicks to maneuver through pages and/or functions.
Analytics Data: We my use internal and/or third-party analytics tools to help us in determining usage maneuvers and trends along with measuring traffic and other information. We may collect information provided by your device or our App and/or Services. Such information may be an aggregate of combined information with other users so as to not personally identify any particular user.
Cookies: When you use our Services, we may use various types of cookies, web beacons, local storage and/or other similar tracking type technologies (“cookies”) on some and/or all of our Services. Cookies can be small files that are passed on to your browser (or other Devices) and stored on your hard drive or memory. The cookies we use may ultimately provide you with a more convenient and faster user experience with our Services.
Our cookies allow us to track, collect and/or store data (and/or your user data) so we are able to recognize and determine: repeat visitors; pages a user visits; functions a user performed; the time a user spends utilizing our Services, and other general user data. This allows us to try and create better Services while providing an overall faster and more rewarding experience for each individual user.
The cookies can also remember such things as your user name and password, Account settings and any other settings and/or preferences you set with our Services. This allows you to navigate through our Services without extra download time each time you visit and can provide you with a more enjoyable experience.
We may use third party advertising sources and other partners and/or affiliates to serve and/or provide ads and/or services to your devices on our App and/or Services which we may benefit from. In such cases, cookies or similar technologies may be used and/or placed by us or the third party.
This information about cookies covers only the use of our cookies and not cookies that other websites, apps or services may utilize. If you connect or link to any other web page, website, app or service from our Services in any manner (such as might occur if you click on a search result, link, search category, banner, advertisement, sponsored link, ad or otherwise) there may be cookies placed on your Device from that source that we do not control and that do not apply to us through your interaction with them and therefore, we will not be held accountable or responsible when you interact with any other source.
1d. Information from advertisers, affiliates, marketing agents and partners:
There may be advertisers and/or websites and/or apps that post ads and/or links and or articles about and/or to our Services and/or on our Services. Some websites and/or apps may utilize a connection to one of our features and/or functions and/or pages (either linking and/or receiving), such as but not limited to: posts, comments, pictures, videos, search, listings and user profile pages. In such cases, we may collect Info that is provided by those advertisers and/or websites and/or apps.
2. HOW WE USE THE COLLECTED INFORMATION:
When you create an Account and/or use our Services, your Info is collected, stored and utilized. The main purpose of collecting your Info is so that we can provide you with a dynamic and customized user experience on our Services while also trying to enhance and create new features for your enjoyment on our Services. When you create an Account and/or use our Services, you agree that we may use your Info to:
Remember your log in information for easier access to our Services.
Connect you with other Chat Card users for you to communicate with them.
Allow others to view your profile page, posts, comments, votes, shares, pictures, videos and feeds in accordance with the type of post you posted and your privacy settings.
Allow you to follow users and other users follow you in which you will be able to see and interact with each other’s posts and content.
Calculate and display your points for games played and points earned through other mechanisms.
Allow other users to send you a Chat Card or communicate with you through posts, comments, voting, messaging in other forms in accordance with the type of post you posted and your privacy settings.
Allow other users to interact with you in how our Services were intended to be used.
Communicate with you regarding our Services through our website, App, messaging system, email, phone, text or mail.
Send you updates, messages, ‘Alerts’ and/or ‘Push Notifications’.
Solicit information and surveys from you.
Customize and/or streamline your experience with our Services.
Automatically upload our Services updates to your Devices.
Process transactions of various forms.
Provide advertising on our Services (which may be customized for you).
Monitor and analyze how you use our Services.
Refine and improve our Services.
Diagnose and/or fix issues with our Services.
Verify your user identity and your connection with other users.
Attempt to prevent fraud, harassment, bullying or other illegal activities.
Perform any other function or purpose for which the Info was collected for.
We may also provide advertising for goods or services unrelated to our Services by either us or a third party advertiser or an affiliate through our website, App, messaging system, email, phone, text or mail (you can ‘opt out’ from receiving these advertisements at any time by contacting us or using the ‘opt out’ feature on any advertisement communication you may receive from us). You may contact us directly via email at: Email@ChatCards.com (please be sure to indicate in the ‘Subject’ line that you wish to ‘opt out’ of receiving marketing materials and advertisements and be sure to include your Account name and the email address you use on your Account).
3. SHARING YOUR INFORMATION:
We do not share your Info with other users, other than that Info of which is needed to be shared for engagement and interaction between users within the normal functionality and capacity of common exchange in how the App (and/or our Services) is intended to be used. Therefore, your content and some of the Info collected by us and provided by you is used in the natural order and exchange between users in how our Services function. Since you will be interacting with others by posting content, voting, commenting and playing games, then some of your Info will be shared with others through the use of our Services such as but not limited to: your posts, your name, date you created your Account, your pictures, images and profile pictures, videos, recordings (video and/or audio), captions, voting information, comments, responses, shares, tags, scores, profile page info (hobbies, school info, birthday, marital or relational status, occupation, etc.), point info and point bank totals, level rankings, number of followers and those you are following, gaming information and leader board positions, along with other Info.
Likewise, users can use our search tool in an attempt to locate you or your content by your name, user name, hashtag or posting content in which case they may have access to that information as well. If you give us permission to access your phone’s contact list, then we may share with people on your contact list the fact that you now have an Account and/or are using our App and/or our Services. If necessary, we may also need to share your Info with service providers who perform duties and/or services on our behalf to assist us in the operation of our App and/or Services.
4. INFORMATION DISPLAYED
(POSTING & OTHER CONTENT):
We offer you three types of posts for which you can display and share your content (and other user’s content) on our App and/or Services. Each type of post will vary in how your Info and content is shared with others. The three posting methods are: Public Posts; Private Posts; Anonymous Posts. All three types of posts that you post can be deleted at any time at your discretion, however, please be aware that once you post content (whether public, private, anonymous, shared or otherwise), others may have copied, saved or taken a screenshot of the image or content, therefore your post/content may still be retained and/or available, circulated, viewable by others even though you deleted it or posted it as private or anonymous. Please use wisdom and discretion when posting and be aware that others have the ability to copy, save and repost it.
A) Public Posts: When you post publicly, some of your Info will be attached to that post identifying you as the one who posted it (such as but not limited to: your name, user name; point bank info; city and state; profile picture). Your content on that post will be available for anyone to see, save and share including all comments, tags and voting and shares that take place. Likewise, your profile page can be viewed by the public and any posts and pictures you posted publically can be accessed and retained or shared by the public on your profile page.
B) Private Posts: When you post privately, those posts may only be accessed by the people you personally select. Private posts cannot be shared through features on our Services. Private posts will have a button on them which will display the list of the names and/or user names (and other Info) of the people who were selected to access the private post (both the sender of the private post and the people who can access the private post can tap the button and view the list of names). When you post privately, some of your Info will be attached to that post identifying you as the one who posted it (such as but not limited to: your name, user name; point bank info; city and state; profile picture). Only those people you select will be able to access your private post.
C) Anonymous Posts: When you post anonymously, your post will be posted publically, but your name, user name, profile picture and other Info are removed from the post. Other users will simply see the content of the post, but the identity of the poster will be displayed as anonymous.
Standard and 24 Hour Posts (Disappearing): When you submit any of the three types of posts, you can also select if you want the post to be ‘standard’ or ‘24 hours’. If you choose standard, your post will remain posted on your profile page and the newsfeeds until you delete it. If you choose 24 hours, your post will have a small red clock on it which signifies that it will automatically delete itself and disappear in 24 hours. Once a 24 hour post disappears, it is permanently deleted and you won’t have access to it again. We cannot guarantee or warranty that any ‘disappearing’ post you submit will expire and be removed from our Services at exactly the 24 hour mark. Posts may expire sooner or later than the 24 hour period.
Private and Anonymous Notice: Although we strive to maintain the integrity of committing to you that your private posts and anonymous posts will remain private and/or anonymous and the posting and display procedure will operate in the manner we present and describe, it is impossible for us to guarantee that there will not be errors at times and your content and/or identity may be presented and/or disclosed to those you did not intend to see or receive it. This may be due to numerous reasons including but not limited to; user manipulation; hacking; coding error; unexpected actions; upgrades; modifications; transitions; acts of God and others. Your content and posts are being presented voluntarily so in such cases where privacy and/or anonymity may have been compromised, failed or the posting and display mechanism did not function and/or perform as expected, you agree that we will not be held responsible or liable for such occurrences along with any detrimental outcome you may have which includes but is not limited to; financial loss, damages of any kind and/or any detriment, disturbance or discomfort thereof that you may experience. Also note and take caution that users may take screenshots or use an external camera to capture the image of any of your content including your public, private and anonymous posts, content and comments and your profile page data and information. Please be cautious and discreet as to what you voluntarily choose to post and what information you release.
Sharing Posts: You can share any post except for private posts. Likewise, other users can share your posts except for your private posts. You can share posts publically, privately or anonymously. All users can view the list of people that have shared a particular post (unless you share it privately or anonymously). If you share a post anonymously, your shared post will be posted publically, but your name and profile picture are omitted from the shared post. If you share a post privately, then only those you select will have access to your shared post and can see that you shared it.
Tagging: When you create a public post, you will have the option to select any people you’d like to ‘tag’. Likewise, people can tag you on posts. Tagging means the people tagged will be sent an ‘alert’ and notified about that particular post. You can only tag people on ‘public’ posts. Tagging is optional, you are not required to tag people when you post. When you are tagged on a post, your name will appear on the ‘tagged’ list for that post. To view a list of the people who were tagged on any specific post, simply tap the ‘Tags’ button located on that post. When you tap the ‘Tags’ button, you’ll see a list of the people that were tagged on that post. If you were tagged on a post, your name will appear on that tag list for other users to see. When viewing the ‘tagged’ list on a shared post, it will show who was tagged by the sharer (not the original poster).
Voting: You can vote on user’s posts and other users can vote on your posts. When you create your post, you will see a list of voting buttons that you can select from. Choose the buttons that best apply to your post. People can then vote on your post by selecting one of the buttons and you can see the results of how people voted. You cannot vote on your own posts. When you vote on other user’s posts, you are allowed to change your vote at anytime. You can view a list of the people that voted on any post by tapping the ‘people’ button next to the voting graph. You cannot see the list of voters on a post until you first vote on that post. Other users can also see the voting results and voter list on your posts. If you vote on a post, other users will be able to see your name and/or user name on the voting list along with the voting button you selected.
Removing and Deleting Posts: Due to our voting concept and our desire to maintain the integrity of the voting results, we do not allow a post to be edited once it has been posted. However, you can delete any post you’ve posted at any time. You can also edit or delete any comments you make (on either your own posts or other posts you commented on). You can also remove posts from your newsfeeds that others have posted. You will not be deleting the actual post since someone else posted it, but you will be removing it from your newsfeed. Just tap the little down pointing arrow on any post to perform these actions. If you delete posts or comments and/or edit any comments, please be aware that once you post something, others may have copied or screenshot the image before you edited or deleted it, therefore it may still be retained and/or circulated by others.
Comments: You can leave comments on your own posts and on other user’s posts and other users can comment on your posts. Your name will be attached to any comment you make on a post. You can delete any comments on your own posts (including those comments left by others). You can edit your own comments at any time on any post. However, when you comment on another user’s post, you can edit and delete only your own comments, but you cannot delete other user’s comments.
Favorites and Saving Pictures: You may save posts to your favorites list and also use the save button on any picture, image or video to save it to your library. Likewise, others can do the same and save your posts, pictures, images and videos to their library. Please note however that when you put a post on your favorites list and the original poster deletes it (or it automatically deletes because it is a 24 hour post), that post will also be deleted from your favorites list.
Newsfeeds: We offer multiple newsfeeds for you to select from to view posts from our users. You will also be able to filter the newsfeeds so that you can see posts from ‘everyone’ or just from ‘people you’re following’. When you post content, your post will appear on specific newsfeeds depending on whether your post is ‘Public’, ‘Private’ or ‘Anonymous’. Your posts may appear on various newsfeeds depending on which categories they qualify for. So your posts may appear in several different newsfeed categories at the same time. Your name will appear as the person who posted the content on all public and private posts (only the people you select can access your private posts). Your name and profile picture are omitted on any anonymous content you post.
Blocking: You can block any user’s account on our App and/or Services at any time and you can also unblock them at any time. Blocking a person’s account will prevent that account from being able to access your profile page and/or follow you and/or receive your posts on their newsfeeds. When you block someone, your account will likewise be unable to access the blocked person’s content. If two people’s accounts mutually block each other, then the content cannot be accessed by either account until both blocks are removed (so if one account unblocks the other account, the content is still restricted for both accounts until the other block is removed). Blocking does not prohibit or prevent you from being able to still report the other person should the need arise. You can still find the blocked person by conducting a search; you can then tap the button on their tab to either unblock them or report them. Please note that blocking an account does not necessarily guarantee that the user of that account can no longer view or access your content. You agree that we will not be held responsible or liable should a blocked account still gain access to your content. Once you block an account, you can unblock that account at any time to remove the restrictions, however, if that account has also put a block on you, then the restrictions will remain until both blocks have been removed.
Reporting: In the event you need to report a person or a specific post for violating our Agreement or for any other legitimate reason, you just need to tap the button on their post and select the reporting preference you desire. Any report submitted to Chat Cards will be confidential and the person submitting the report will not be identified or broadcast to others. We will investigate and examine all reports submitted to us on an individual basis to determine if any action is needed and what the appropriate response and recourse in each circumstance may be. You will not receive information or an update as to the outcome and/or action of our decision.
Push Notifications: You can also grant us permission to provide you with ‘Push Notifications’ which can alert you to such things as, but not limited to: new followers, new private posts, new votes, new comments, new shares and more. The push notifications will keep you instantly updated in near real time and will attempt to enhance your overall fun and enjoyment in using our App and/or Services. When using some of our features, such as but not limited to: posting content, writing captions and comments, voting, playing games, following someone, etc., such Info will therefore be shared with friends and/or the public that you are engaging with via push notifications and/or through other methods (such as but not limited to ‘Alerts’), they will also be able to see your posts and content on the various newsfeeds. When you perform certain actions on our App and/or Services, your name may appear on the push notifications sent to others. You can always revoke your permission for push notifications to be sent to you by using the settings feature on the App or the setting preferences function of your Device. We may also share dissected and/or aggregated Info of yours that is not personally identifiable information about you and is of a nondescript nature. We may share this Info with service providers, advertisers, partners or others.
5. DISCLOSURE OF YOUR INFORMATION:
We also may disclose your content and/or Info:
In response to a court order, subpoena, or as otherwise required by law.
To law enforcement or other governmental officials in response to requests relating to possible criminal, illegal or terrorist activity.
If necessary to protect the rights, property and safety of others against any fraud, harassment, bullying, infringement or other wrongdoings.
If necessary to those who assist us in the operation of our Services and our business.
To third parties at your express written request.
If necessary, to our subsidiaries, if any.
To our successors and assigns in the event we merge with another entity or sell our assets or company (in whole or part) to another entity.
Info Access by Company Acquisition: In the event that our Services (in whole or in part) are purchased by, merged with and/or acquired by a third party or separate entity, we retain the right to transfer all user content, Accounts and Info that we’ve obtained, collected and/or stored from the use of our Services to the third party. In the event of bankruptcy, insolvency, reorganization, receivership or the assignment of benefits to the restitution of creditors, we may no longer be in control of corporate assets and thus, any content, Accounts and/or Info on our Services may no longer be controlled by us.
6. HOW WE STORE YOUR INFORMATION:
The Services that are provided by us are hosted from facilities located in the United States and all Info that we collect and that you provide is stored in our servers here in the United States. We may maintain and/or store and or utilize your content and/or Info for a length of time solely determined by us and at our discretion.
Upon you removing content and/or Info from your Account and/or upon you deactivating your Account or us suspending and/or terminating your Account, or you deleting our App and/or Services from your Devices, you agree that we reserve the right to continue to store and maintain (for a length of time solely determined by us) any content and/or Info you provided (or we collected) at any time to/by us (or through our Services) along with us being able to continue to utilize (for a length of time solely determined by us) any content and/or Info you provided (or that we collected) at any time and obtained by us and/or that was shared/provided to other users through our Services. Please note that after your content and/or Info has been removed from your Account and/or your Account has been deactivated, suspended and/or terminated or you have deleted our App and/or Services from your Devices, your content and/or Info may still be available and viewed on our Services by others if it was sent, transmitted, received, posted, shared or copied by you and/or other users and thus, displayed, received, captured and/or stored in other user Accounts. You grant us the right to display such content at our discretion.
7. ACCOUNT AND PASSWORD PROTECTION:
When you create an Account, you will be required to provide personally identifiable information and you may allow us to access other personal and/or private information on your Devices – you will also be required to create a password. You agree that all information you provide to us when you create your Account and whenever you update your information will be truthful, current and correct.
You are solely responsible for maintaining the confidentiality and security of your password and Account information and for any and/or all activity that occurs through your Account. You should not give your password or log-in information to other people. In the event your password is lost or stolen, you should change your password immediately using the ‘Change Password’ tool on the App. If you have forgotten your password, use the ‘Forgot Password’ tool on the ‘log in’ page of the App to get a new password sent to the email address you have listed on your Account. We are not responsible or liable for any harm, loss, augmentation or mutation of data or any type of activity that may occur should your Account become breached or compromised for any reason (including but not limited to your negligence or the hacking of our Services). It is prohibited for you to market, offer, transfer, barter, sell or assign your Account to another party. So please do your part in helping us protect your Account and Info. Beware of scam artists who might masquerade as us in an attempt to get into your Account or to obtain your Info or personal information. Should we ever need to validate or obtain Info from you, we will contact you and direct you to provide the requested information through our App – or in some cases, we may direct you to our website or Services and instruct you to use our correct website address: www.ChatCards.com. 8. VIEWING AND CHANGING YOUR ACCOUNT INFORMATION:
You can view and/or change and/or edit your Account information, password and profile picture at any time by simply logging in and then tapping the ‘more’ button on the homepage of the App and then tapping the ‘View / Edit My Account’ tab. We may retain a record of the Account Info that you previously provided for a period of time determined solely by us.
We have taken reasonable measures to secure and protect your content and/or Info (along with the storage thereof) from unauthorized access, usage or disclosure. We operate secure data networks in order to attempt to protect your Info and only those we authorize to access the Info are allowed to do so. All banking and/or credit card and/or debit card information and/or transactions you perform with us will be done using encrypted programs through an authorized licensed processing agent. However, despite our efforts to protect your Info, we do not ensure the safety and security of any Info we collect, store or that you transmit or provide to us or that we gather nor do we guarantee that a breach cannot occur and that we will be able to prevent the loss, theft, misappropriation, disclosure, misuse, abuse and/or alteration of your content, identity and/or Info that may result in hardship and/or financial loss. By using our Services, you agree to hold us harmless and affirm we will not be liable in all such matters.
10. FOLLOWERS & FOLLOWING:
We offer a simple ‘following’ system that allows you to follow people so you can receive their posts and content on your newsfeeds. Likewise, people can follow you and receive your posts and content on their newsfeeds. You and others can use our search tool, contacts tool, newsfeeds and/or other methods to find people and follow them. To follow someone, just tap the ‘plus’ button on their post (or next to their name) and the button will turn into a right foot icon. To unfollow someone, just tap the right foot icon button and it will turn back into the ‘plus’ button.
When you follow someone, they will receive a notification that you are now following them. Likewise, when someone follows you, you will receive a notification that they are now following you. When you unfollow someone, they will not be notified that you are no longer following them. You can view a list of the people you’re following and the people following you by tapping the ‘2 people’ icon button located at the bottom button bar of the homepage newsfeed page or by going to your profile page. You can also go to other user’s profile pages to view their ‘follower/following’ list (and other users can go to your profile page to view your list of your followers and the people you’re following).
Please note that we do not check, validate and/or verify the backgrounds or identities of users of our Services and we will not be responsible for any content, dealings, communication, Info sharing or interaction between you and others (whether they are people you know or don’t know). Thus, you should act with caution with regard to following others or sharing any of your content and Info with others. Likewise, you should monitor the people who choose to follow you and you should block any suspicious Account from following and communicating with you.
11. MARKETING AND THIRD-PARTY AFFILIATES & ADVERTISERS:
PRIMARY ADVERTISING: We may post banners, advertisements and links on our Services that offer products and/or services offered by us, our affiliates, or third parties (in which the goods or services being offered may or may not be related and/or associated with our Services). Our computer system may match such offers with you based upon your Info that we have along with your content and the interactions and usage you perform on our Services. If you click on a banner, advertisement or link, you may be communicating directly with our affiliate or a third party and may no longer be on our Services, therefore, the data collection and use practices of that entity will control at that time. Our Services may allow or invite you to use newsfeeds, messaging systems, blogs, chat rooms, email programs, message boards, forums, news groups, instant live messaging, profile pages, posts, sharing programs, commenting, video or image transfer and/or similar communication channels. Please note that any information, pictures, videos, content and/or Info you share, send or post in such channels may become public information that is available for others to view, copy and/or extract. We will not be able to safeguard any information and/or content and/or Info that you disclose and/or provide openly or to third parties and/or to users and/or to your friends on our Services and we will not be responsible or held liable so please act with caution.
14. CONTACTING US ABOUT A DECEASED OR INCAPACITATED USER:
Should a user become incapacitate or deceased and legal rights to the assets and/or holdings of that user are legally transferred to you, then you may contact us regarding the Account, content and/or Info if you are legally in authority. In the event that we discover through verified means that a child under the age of 13 has registered an Account for our Services and/or provided us personal information and/or Info, we will remove that Account from our Services in a timely fashion as quickly as possible. Please note that any content or Info that was sent, shared, posted or transmitted to other users by the minor may still be displayed and viewable through the other user Accounts which received, copied, shared or viewed the Info. When such additional Info or content is found and/or reported to us, we will remove such material.

16. TERMINATION OF YOUR ACCOUNT:
In our sole discretion, we may pause, limit, suspend, cancel, modify and/or terminate your profile page and/or your Account and/or membership (whether active, dormant and/or inactive) at any time and for any reason we deem necessary or appropriate. Any points, rankings, credits, feedback, ads, listings, photos, videos, messages, postings, data, content, Info and/or value mechanisms (tangible or intangible) attributed to the user and/or to your Account will be withdrawn without refund, reimbursement or restitution in any form to the user or entity (this also includes non-refund of any payment made to us for a premium Account). Upon suspension or termination, all fees and charges owed to us by you and/or your Account are immediately due and payable.
Upon your deactivation and/or our suspension and/or termination of your Account, you agree that we reserve the right to continue to store and maintain (for a length of time solely determined by us) any content and/or Info you provided (or we collected) at any time to/by us (or through our Services) along with us being able to continue to utilize (for a length of time solely determined by us) any content and/or Info you provided (or that we collected) at any time and obtained by us and/or that was shared/posted, provided, transmitted and/or sent to other users by your Account through our Services.
At our discretion, we may block or prevent you from attempting any future access to using our Services. If we have limited, suspended or terminated your profile page and/or Account and/or membership, you may not attempt to circumvent the action we have taken by accessing and/or operating on our Services by creating another Account (whether under your name, a modified name, or under other names or fictitious and/or real names or by utilizing other ISPs or Accounts to attempt to access our Services). Upon suspension and/or termination of your Account, all licenses and/or other rights and privileges provided to you through our Agreement for our Services will cease immediately and entirely.
Please note that after your deactivation and/or our suspension or termination of your Account, your content and/or Info may still be available and viewed on our Services by others if it was posted, sent, shared or copied by you and/or other users and thus, displayed, captured and/or stored in other user Accounts.
